Secure Research Environment (SRE) Terms of Use

This page describes the Terms of Use for the Secure Research Environment (“SRE”) by Eligible Researchers (as defined under our Research Data Access Framework). Your access to and use of the SRE will be governed by these Terms of Use. Population Data BC reserves the right to amend the Terms of Use at any time without notice.

Ownership

The SRE is the property of Population Data BC. The SRE is protected by Canadian and international copyright, trademark, and other laws. Population Data BC has made various health information Data Sets available from government ministries and public agencies (collectively, the “Data Stewards”) through the SRE under the terms of an Information Sharing Agreement with each Data Steward, and each Data Steward retains ownership of its Data Sets.

Your use of the SRE does not transfer to you any ownership or other rights in the SRE, any of its content, or any of the software that you obtain from Population Data BC to access the SRE. You shall not copy, redistribute, reproduce or republish any content from the SRE in any form without the written permission of Population Data BC and any applicable Data Steward.

Limitation of Liability

Although Population Data BC makes all reasonable efforts to ensure that the content in the SRE is correct, its accuracy cannot be guaranteed and Population Data BC or any Data Steward makes no warranties or representations as to the accuracy or reliability of any information, data, opinions, advice, or statements on the SRE. All content within the SRE is provided to you on an “as is” and “as available” basis, for information or educational purposes only.

Population Data BC, The University of British Columbia or any Data Steward shall not be responsible for any direct, indirect, special, incidental or consequential damage or any other damages whatsoever and howsoever caused, arising out of or in connection with the use of the SRE or in reliance on the information available with the SRE, including the loss of use, lost data, lost business profits, business interruption, personal injury, or any other personal or pecuniary loss, whether the action is in contract, tort (including negligence) or other tortious action.

Links to third-party websites

The SRE may contain links to third-party websites, which are not under the control of Population Data BC. Population Data BC makes no representations whatsoever about any other website you may have learned of or acquired via the SRE. When you access a third-party website, you do so at your own risk.  Population Data BC is not responsible for the privacy practices of these websites, or for the accuracy or reliability of any information, data, opinions, advice, or statements made on these websites. Population Data BC provides these links merely as a convenience, and the inclusion of such links does not imply that Population Data BC endorses or accepts any responsibility for the content or uses of such websites.

Accounts, Passwords and Security Tokens

The content within the SRE is only available to Eligible Researchers (as defined under our Research Data Access Framework) to whom Population Data BC at its sole discretion has assigned an account (the “Account”) and, in most cases, a security token.

You agree to only access the content within the SRE using your Account, and not with any other user’s account. You certify that the identity information that you used to obtain your Account from Population Data BC is true and correct. You also agree to only use one Account, and if you are inadvertently or accidentally assigned more than one Account, you agree to report the multiple Accounts to Population Data BC.  If you cease to be an Eligible Researcher, you also agree to report your change in status immediately to Population Data BC.

You agree that Population Data BC will at its sole discretion limit the access of your Account to only specific parts of the SRE, and may change the limits of your access at any time. Depending on the data that you request access to within the SRE, Population Data BC may at its sole discretion require you to undertake privacy training, and/or sign and execute a non-disclosure agreement prior to granting you access to the data.

You are responsible for the care and control of your password and, if assigned a security token, personal identification number to your Account for the SRE, including:

You acknowledge and agree that Population Data BC has the right to monitor your use of the SRE, and that Population Data BC may suspend or deactivate your Account without notice if we suspect that it has been compromised, or if your Account has been used for a purpose that breaches these Terms of Use, your Researcher Services Agreement or your Research Agreement, or if we believe that you have ceased to be an Eligible Researcher.  If your Account is deactivated, you agree to return any security token that Population Data BC has provided to you.

Computer maintenance

You agree to keep your computer system used to access the SRE in good operating condition, and to make a reasonable effort to install security updates and patches published by the supplier of the operating system for your computer system.

Access and interference

You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the SRE, or to bypass or defeat any security controls of the SRE. You also agree that you will not use any robot, spider, other automatic device, or manual process to impose an “unreasonable or disproportionately large load” on the SRE. An “unreasonable or disproportionately large load” is one that prevents other visitors from gaining fair and equitable access to the SRE, or other websites or resources at Population Data BC or The University of British Columbia.

Indemnification

You agree to indemnify, defend and hold harmless Population Data BC, The University of British Columbia, any applicable Data Steward and each of their respective officers, directors, employees and agents from and against any and all claims, demands, loss, damage, cost or expense, including without limitation reasonable legal fees, resulting from or related to:

You shall cooperate as fully as reasonably required in the defense of any claim. Population Data BC and The University of British Columbia reserve the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.
