Researcher Forums Terms of Use

This section describes the Terms of Use for Population Data BC’s Forums (the “Forums”) for Researchers with active PopData projects. Your access to and use of the Forums will be governed by these Terms of Use. Population Data BC reserves the right to amend the Terms of Use at any time without notice.

Other content provided by Population Data BC are covered by separate terms of use.


When you post content in a Posting to the Forums, you automatically grant Population Data BC an irrevocable, non-exclusive, royalty-free right and license to use, copy, transmit, communicate or publicly display that content within the Forums or on other websites controlled by Population Data BC. All users of the Forums (the “Users”) understand that their Postings can be viewed by other Users of the Forums, and that Population Data BC cannot guarantee the confidentiality of any Posting made in the Forums.  Content from Data Extracts obtained from Data Stewards shall not be posted.

The Forums are the property of Population Data BC. The Forums are protected by Canadian and international copyright, trademark, and other laws. Your use of the Forums does not transfer to you any ownership or other rights in the Forums or any of its content. You shall not copy, redistribute, reproduce or republish any content from the Forums in any form outside of the Forums without the permission of Population Data BC.

Decorum and Appropriate Content for Postings

You are asked to use respectful language in your Postings. In a community full of opinions, people will disagree.  Please debate, but do not attack others.

Any Posting containing the following content or links to third party websites containing the following content are strictly prohibited:

You acknowledge and agree that Population Data BC has the right to monitor the Forums, and that Population Data BC reserves the right at its sole discretion to refuse to publish or remove any Postings that are unacceptable, undesirable or violate these Terms of Use.  You shall not attempt to re-post the content of any Posting that has been removed.

Responsibility for Postings in the Forums and Limitation of Liability

Population Data BC or any public body data provider cannot be responsible for the accuracy or reliability of any information, data, opinions, advice or statements (hereafter referred to as “Postings”) made by Users.  All content within the Forums is provided to you on an “as is” and “as available” basis, for information or educational purposes only.

Population Data BC, The University of British Columbia or any public body data provider shall not be responsible for any direct, indirect, special, incidental or consequential damage or any other damages whatsoever and howsoever caused, arising out of or in connection with the use of the Forums or in reliance on the information available on the Forums, including the loss of use, lost data, lost business profits, business interruption, personal injury, or any other personal or pecuniary loss, whether the action is in contract, tort (including negligence) or other tortious action.

Links to third-party websites

Postings may contain links to third-party websites, which are not under the control of Population Data BC.  Population Data BC makes no representations whatsoever about any other website to which you may have access through the Forums. When you access a third-party website, you do so at your own risk and Population Data BC is not responsible for the privacy practices of these websites, or for the accuracy or reliability of any information, data, opinions, advice, or statements made on these websites.

Accounts and Passwords

You agree to only access the Forums and post content in a Posting using the account that has been assigned to you by Population Data BC for use with the Forums (the “Account”). You certify that the identity information that you used to obtain your Account from Population Data BC is true and correct.  You also agree to only use one Account, and if you are inadvertently or accidentally assigned more than one Account, you agree to report the multiple Accounts to Population Data BC. You also agree that Population Data BC may at its sole discretion limit the access of your Account to only specific parts of the Forums, and may change the limits of your access at any time.
You are responsible for the care and control of your password to your Account for the Forums, including:

Population Data BC may suspend or deactivate your Account without notice if we suspect that it has been compromised or if your Account has been used for a purpose that breaches these Terms of Use.

Computer maintenance

You agree to keep your computer system used to access the Forums in good operating condition, and to make a reasonable effort to install security updates and patches published by the supplier of the operating system for your computer system.

Access and interference

You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Forums, or to bypass or defeat any security controls of the Forums. You also agree that you will not use any robot, spider, other automatic device, or manual process to impose an “unreasonable or disproportionately large load” on the Forums. An “unreasonable or disproportionately large load” is one that prevents other visitors from gaining fair and equitable access to the Forums, or other websites or resources at Population Data BC or The University of British Columbia.


You agree to indemnify, defend and hold harmless Population Data BC and The University of British Columbia and each of their respective officers, directors, employees and agents from and against any and all claims, demands, loss, damage, cost or expense, including without limitation reasonable legal fees, resulting from or related to:

You shall cooperate as fully as reasonably required in the defense of any claim. Population Data BC and The University of British Columbia reserve the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.


The Population Data BC logo is a trademark of Population Data BC, as a unit of The University of British Columbia.


If any provision of these Terms of Use is declared invalid or unenforceable, the remaining provisions shall remain in full force or effect.

Jurisdiction and applicable law

These Terms of Use will be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada, notwithstanding any conflict of laws provisions of your domicile, residence or physical location. You hereby consent and submit to the exclusive jurisdiction of the courts of the Province of British Columbia in any action or proceeding instituted under or related to your use of the Forums.
